These Terms & Conditions (“Agreement”) constitute a legally binding agreement between you and Demi Strength Pilates Inc., an Ontario, Canada corporation, including its on-demand platform branded as “Demi On Demand” (a business name and/or division of Demi Strength Pilates Inc.) (“Demi Strength Pilates,” “Demi On Demand,” “Company,” “we,” “us,” or “our”), governing your access to and use of our websites, applications, subscriptions, on-demand content, live classes, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by this Agreement. If you do not agree, you must not use the Services.
Assumption of Risk & Medical Disclaimer
You acknowledge that Pilates, strength training, and physical exercise involve inherent risks, including serious injury or death. You voluntarily assume all risks associated with participation.
The Services do not provide medical advice. All content is for educational and informational purposes only. You are responsible for consulting a qualified healthcare professional prior to participation.
Waiver & Release of Liability
To the fullest extent permitted by law, you irrevocably release, waive, discharge, and hold harmless Demi Strength Pilates Inc., Demi On Demand, and their respective officers, directors, founders, owners, shareholders, instructors, contractors, employees, agents, representatives, successors, and assigns, including without limitation Demi Lykos, from any and all claims, damages, liabilities, losses, or causes of action arising out of or related to your use of the Services or participation in any physical activity, whether in-studio, live online, or on-demand.
This release includes claims based on ordinary negligence, instruction or lack of instruction, premises liability, equipment use, online instruction, or digital content, except where liability cannot be excluded by law.
Accounts & Eligibility
You must be at least 18 years old to create an account unless otherwise permitted by law. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.
Payments, Memberships & NO REFUNDS
ALL PURCHASES ARE FINAL. All classes, subscriptions, digital programs, MONTHLY MEMBERSHIPS, and ANNUAL MEMBERSHIPS are NON-REFUNDABLE, NON-TRANSFERABLE, AND NON-CREDITABLE, without exception, regardless of usage, injury, dissatisfaction, scheduling conflicts, technical issues, or early termination.
Subscriptions automatically renew unless canceled prior to the next billing date. CANCELLATIONS MUST BE COMPLETED DIRECTLY WITHIN THE APP OR ACCOUNT SETTINGS. Email, verbal, social media, or third-party cancellation requests are not valid and will not stop billing.
By submitting payment, you authorize recurring charges to your payment method on file.
Intellectual Property
All content, including videos, programs, trademarks, branding, and materials, is the exclusive property of Demi Strength Pilates Inc. Content is licensed for personal, non-commercial use only. Unauthorized copying, recording, distribution, or resale is strictly prohibited.
Indemnification
You agree to indemnify and hold harmless Demi Strength Pilates Inc., Demi On Demand, and all released parties from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Services, violation of this Agreement, or infringement of any third-party rights.
Governing Law & Dispute Resolution
This Agreement is governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute shall first be attempted to be resolved informally and, if unresolved, may be submitted to binding arbitration in Ontario, Canada, except where prohibited by law.
Modifications & Termination
We may modify these Terms at any time. Continued use of the Services constitutes acceptance of updated terms. We reserve the right to suspend or terminate access at our discretion.
